Welcome to A Lovely Everyday.

These Terms of Service govern your use of alovelyeveryday.com, including The Experience Studio, The Letter, our online shop, customer-account features, digital experiences, and other services we make available through the website.

The website and direct-to-consumer shop are operated by AGB Brands, LLC d/b/a A Lovely Everyday. Throughout these Terms, “A Lovely Everyday,” “we,” “us,” and “our” refer to AGB Brands, LLC d/b/a A Lovely Everyday.

By visiting the website, creating or using an account, interacting with our digital experiences, submitting information through the site, or purchasing products directly from us, you agree to these Terms of Service and any policies incorporated into them.

Please read them carefully.

1. About These Terms

These Terms apply to your use of alovelyeveryday.com and to purchases made directly through A Lovely Everyday unless otherwise stated.

They should be read together with our:

Any additional terms presented for a particular offer, promotion, program, product, or experience

Purchases or interactions that take place through third-party platforms such as Etsy or Faire may also be governed by that platform’s terms, policies, and transaction processes.

If a specific product, promotion, program, or service includes additional terms, those additional terms also apply to that particular offering.

2. Eligibility and Lawful Use

By using the website, you represent that you are legally able to enter into these Terms in your jurisdiction or that you are using the site with the involvement and permission of a parent or legal guardian where required.

You may not use our website, services, digital experiences, or products for an unlawful purpose or in a way that violates applicable law or the rights of another person.

You may not attempt to interfere with the security, availability, functionality, integrity, or operation of the website or any system connected to it.

3. The Experience Studio and Digital Experiences

The Experience Studio is A Lovely Everyday’s collection of interactive digital experiences, tools, discovery environments, editorial connections, and other ways to engage with The Art of Real Daily Living.

Features may include experiences such as:

The Color Combo Creator
The Prompt Generator
Product-discovery experiences
Customer-account and saved-content features
Other interactive tools introduced over time

Digital experiences may change, evolve, be tested, be replaced, or be discontinued as A Lovely Everyday develops.

Unless we expressly state otherwise, digital experiences are provided for personal, informational, creative, organizational, or entertainment purposes. They are not professional medical, mental-health, legal, financial, or other licensed professional advice.

You remain responsible for deciding whether and how to use information, suggestions, prompts, recommendations, or outputs provided through an A Lovely Everyday experience.

4. Products and Product Information

We work to describe and photograph our products accurately and to maintain reliable product information.

Product information may include:

Paper type and weight
Size and dimensions
Page count
Interior or ruling
Materials
Color
Finish or edge treatment
Compatibility
Care and use guidance
Suggested uses
Product availability
Other specifications

Colors and physical details may appear somewhat different depending on lighting, photography, display settings, screen characteristics, natural material variation, manufacturing variation, and other factors.

Where a product has natural, handmade, small-batch, material, or production variation, reasonable variation may occur between individual items.

We correct product-information errors when we identify them and do not intentionally turn an unverified assumption into a factual product claim.

5. Product Availability

Products are subject to availability.

Some products may be:

Limited release
Seasonal
Small batch
Experimental
Returning
Phased out
Available only in selected configurations
Available only through particular channels or programs
Available only while supplies last

We may add, discontinue, pause, restock, revise, or limit products and configurations.

Displaying a product on the website does not guarantee that it will remain available for purchase.

6. Pricing, Taxes, and Payment

Unless otherwise stated, prices on alovelyeveryday.com are displayed in U.S. dollars.

Applicable taxes, shipping charges, and other order-specific amounts will be shown where required during checkout.

We may change product prices, promotions, or discounts at any time before a purchase is completed.

If we discover a material pricing, product, inventory, or checkout error, we may correct the error and, where appropriate, contact you regarding the affected order.

Payment must be successfully authorized through the available checkout method before an order can proceed.

Payment processing may be provided by Shopify or another authorized payment provider and may be subject to that provider’s applicable terms and privacy practices.

7. Order Acceptance

An automated order confirmation means that we received your order. It does not necessarily mean that every portion of the order has been finally accepted for fulfillment.

We may refuse, limit, or cancel an order when reasonably necessary, including because of:

Suspected fraud or unauthorized activity
Payment problems
Material pricing or listing errors
Inventory discrepancies
Shipping or legal restrictions
Abuse of promotions or programs
Violation of these Terms
Another circumstance that prevents us from lawfully or reasonably fulfilling the order

If A Lovely Everyday cancels merchandise after payment has been collected, we will provide the appropriate refund for the canceled merchandise.

8. Shipping and Delivery

Direct A Lovely Everyday orders are fulfilled according to our Shipping Policy.

Our standard processing timeframe is generally 7–14 business days, unless a different timeframe is stated for a particular product, preorder, release, or order.

Processing time and carrier transit time are separate.

Please review your shipping address before submitting an order. How an address problem is resolved depends on the circumstances and whether the error originated with A Lovely Everyday or with the information submitted with the order.

If we learn that we cannot ship merchandise within a timeframe we stated, we will provide the delay, cancellation, and refund options required by applicable law.

Delayed, potentially lost, returned-to-sender, damaged, and delivered-but-not-received packages are handled according to our Shipping & Delivery Policy and the circumstances of the individual shipment.

9. Returns, Exchanges, and Refunds

Returns, exchanges, refunds, damaged-item claims, and related customer-care requests are governed by our Returns & Exchanges Policy.

Eligible unused merchandise may qualify for a store credit or exchange when the applicable requirements are met.

Damage, defects, incorrect merchandise, and fulfillment errors are handled separately from ordinary preference returns and may result in a replacement, exchange, store credit, refund, or another appropriate resolution depending on the circumstances.

A product is considered Final Sale only when it is specifically identified as Final Sale at or before purchase.

Nothing in these Terms or our policies limits a consumer right or remedy that cannot lawfully be limited.

10. Paper Fit Promise

The A Lovely Everyday Paper Fit Promise is a separate customer-care program for qualifying paper-related concerns.

It is not the same as an ordinary preference return, product-defect claim, or general refund program.

Eligibility, claim timing, qualifying channels, previous claims, product condition, return requirements, and available resolutions are governed by the Paper Fit Promise terms applicable at the time of the request.

Wholesale purchases are not eligible for the retail Paper Fit Promise.

11. Store Credit

A Lovely Everyday may issue store credit as a customer-care resolution, return resolution, promotion, reward, goodwill gesture, or for another approved reason.

Store credit issued through Shopify is associated with the applicable customer account and may require the customer to sign in through a supported customer-account or checkout experience in order to view or redeem it.

Store credit may be subject to additional terms communicated when it is issued.

Where an expiration date applies, it will be communicated as required. Where no expiration date is assigned, the credit will remain subject to the functionality and terms of the applicable store-credit system.

Store credit is not a substitute for a refund when a refund is required by applicable law.

12. Gift Cards

If A Lovely Everyday offers gift cards in the future, the terms applicable to those gift cards will be provided with the offering and will be subject to applicable law.

Nothing in these Terms should be interpreted as a representation that gift cards are currently available unless they are actually offered through the shop.

13. Discount Codes, Promotions, and Special Offers

Discount codes, promotional offers, subscriber incentives, rewards, and other special offers are subject to their stated terms.

Unless expressly permitted:

Offers may not be combined
A promotion applies only during its stated availability period
Eligibility requirements must be met
Discounts cannot ordinarily be applied retroactively to a completed purchase

We may correct or discontinue an offer that contains an error, is being abused, or is being used contrary to its stated terms.

Additional program terms may apply to loyalty, rewards, referral, collaboration, limited-access, or other programs introduced in the future.

14. Customer Accounts

Some features of A Lovely Everyday may work through Shopify Customer Accounts or another supported account experience.

You are responsible for maintaining control of access to your email account, devices, and authentication methods used to access your customer account.

Account features may include order information, store credit, saved information, product or experience preferences, or other functionality made available over time.

We may change the functionality of customer accounts as the A Lovely Everyday experience evolves.

Our collection, use, retention, and handling of personal information associated with customer accounts are governed by our Privacy Policy.

15. Email and Other Communications

If you voluntarily subscribe to A Lovely Everyday marketing communications, we may send you newsletters, product updates, editorial discoveries, new experiences, promotions, special offers, and other marketing communications consistent with the consent you provided.

You may unsubscribe from marketing emails using the unsubscribe mechanism included in those communications.

Transactional, account, security, customer-care, order, shipping, return, or other service-related communications are not necessarily marketing communications and may still be sent when reasonably necessary to provide a service you requested or manage our relationship with you.

A product-specific alert, Watch, launch notification, or similar request does not automatically constitute consent to receive unrelated general marketing unless that consent is separately obtained.

16. The Letter and Editorial Content

The Letter is A Lovely Everyday’s editorial publication about The Art of Real Daily Living.

Editorial content may include stories, guides, interviews, observations, recommendations, product education, third-party references, and other material.

We work to distinguish factual claims from editorial opinion and interpretation and to support factual claims with appropriate sources where applicable.

Editorial content is provided for informational and editorial purposes. It should not be treated as a substitute for professional advice when a subject requires legal, medical, financial, safety, regulatory, or other qualified professional guidance.

Products, businesses, people, places, or resources mentioned in editorial content may change after publication. We may update editorial content when appropriate but do not guarantee that every older article remains continuously current.

Material relationships, sponsorships, affiliate relationships, gifted products, and other relevant editorial disclosures are handled according to our Disclosures & Editorial Standards.

17. Intellectual Property

The A Lovely Everyday website and its original content, including branding, trademarks, logos, product photography, written copy, editorial content, graphics, illustrations, designs, digital experiences, software, interface elements, product concepts, and other creative material, are owned by AGB Brands, LLC or used with authorization, except where otherwise identified.

You may access and use the website for your personal, noncommercial use.

Unless permitted by law or expressly authorized by us, you may not copy, reproduce, republish, distribute, sell, license, commercially exploit, modify, scrape, systematically extract, or create derivative works from A Lovely Everyday content or intellectual property.

Third-party trademarks, content, photography, products, and other intellectual property remain the property of their respective owners.

18. User Reviews, Public Submissions, and Community Content

You may have opportunities to submit reviews, comments, photographs, color combinations, public community contributions, responses to campaigns, or other content.

You are responsible for content you submit and must have the right to submit it.

You may not submit content that:

Is unlawful, fraudulent, threatening, harassing, defamatory, obscene, or intentionally misleading
Infringes another person’s intellectual-property, privacy, publicity, or other rights
Contains malware or harmful code
Impersonates another person
Manipulates or abuses a review, reward, community, or promotional system

When A Lovely Everyday specifically invites content for public display, promotion, publication, a community feature, or another identified use, the applicable submission terms will explain how that content may be used.

Submitting private Customer Care evidence—such as photographs of a damaged package or product—does not by itself give A Lovely Everyday permission to use that material for advertising, social media, editorial publication, or other promotional purposes.

We may moderate, decline, remove, or restrict public-facing user content where reasonably appropriate.

19. Requests, Feedback, and Unsolicited Ideas

We welcome useful feedback about A Lovely Everyday, our products, website, experiences, and services.

Unless we have entered into a separate confidentiality agreement with you, feedback or unsolicited ideas submitted through a general feedback pathway should not be considered confidential.

Please do not submit confidential business information, proprietary concepts, trade secrets, or other information you expect us to hold in confidence through a general feedback form.

Creative collaboration proposals should be submitted through the appropriate A Lovely Everyday collaboration pathway rather than a general feedback form.

20. Third-Party Platforms, Links, and Services

A Lovely Everyday uses or links to third-party platforms and services.

These may include services such as:

Shopify
Payment providers
Shipping carriers
Etsy
Faire
Pinterest
Social platforms
Analytics providers
Email or communications services
Other applications and service providers

Third-party services are governed by their own terms and privacy practices.

A link to a third-party website does not mean that A Lovely Everyday controls that website or is responsible for all of its content, products, security, policies, or practices.

When a transaction takes place directly through Etsy, Faire, or another third-party marketplace, the applicable marketplace terms and transaction processes also apply.

21. Accuracy and Website Changes

We work to keep the website useful, accurate, and current, but information can occasionally contain an error or become outdated.

We may correct errors, revise information, update functionality, or make changes to products, experiences, editorial content, policies, pricing, or website features.

Where an error materially affects an existing order or a customer’s rights, we will handle the situation according to applicable law and the relevant A Lovely Everyday policy.

22. Prohibited Uses

You may not use the website, services, accounts, submissions, or digital experiences:

For an unlawful or fraudulent purpose
To violate applicable laws or regulations
To infringe our intellectual property or the rights of another person
To submit knowingly false or misleading information
To introduce viruses, malicious code, or other harmful technology
To interfere with website security, accounts, systems, or functionality
To attempt unauthorized access to data or services
To collect personal information from others without authorization
To harass, threaten, abuse, discriminate against, or harm another person
To impersonate another person or organization
To manipulate promotions, rewards, reviews, submissions, community features, or purchasing limits
To use automated methods in a way that materially disrupts the operation of the site

We may restrict or terminate access when reasonably necessary to address prohibited activity, security concerns, fraud, abuse, or violations of these Terms.

23. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website, digital experiences, and services are provided on an “as is” and “as available” basis except where we expressly state otherwise.

We do not guarantee that the website or every digital feature will always be uninterrupted, error-free, continuously available, or compatible with every device, browser, or third-party service.

Any product warranty, guarantee, statutory warranty, or consumer right that cannot lawfully be excluded or limited remains unaffected.

Nothing in these Terms is intended to disclaim a warranty or consumer protection that applicable law does not permit us to disclaim.

24. Limitation of Liability

To the fullest extent permitted by applicable law, AGB Brands, LLC d/b/a A Lovely Everyday and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to use of the website, digital experiences, or services.

This limitation does not apply where liability cannot legally be excluded or limited.

Nothing in these Terms limits responsibility for a refund, replacement, remedy, statutory right, or other obligation that A Lovely Everyday is required to provide under applicable law.

25. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless AGB Brands, LLC d/b/a A Lovely Everyday and its officers, employees, contractors, affiliates, and service providers from third-party claims, losses, liabilities, or reasonable expenses arising from your unlawful misuse of the website, your material breach of these Terms, or your infringement of another person’s rights.

This provision does not require you to indemnify A Lovely Everyday for conduct for which indemnification cannot lawfully be required.

26. Privacy

Your use of the website and submission of personal information are subject to our Privacy Policy.

Our Privacy Policy describes how personal information may be collected, used, disclosed, retained, and otherwise handled in connection with A Lovely Everyday and the services that support our website.

27. Changes to These Terms

We may update these Terms when our business, website, services, policies, technology, or legal obligations change.

When we make changes, we will post the updated Terms and revise the “Last updated” date.

Changes apply from the effective date stated or posted and do not eliminate rights or obligations that cannot lawfully be changed retroactively.

Your continued use of the website after updated Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law.

28. Severability

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the extent reasonably necessary, and the remaining provisions will continue to apply to the extent permitted by law.

29. No Waiver

If A Lovely Everyday does not immediately enforce a provision of these Terms, that does not necessarily mean we have waived the right to enforce that provision later.

30. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent that mandatory consumer-protection or other applicable law provides otherwise.

Nothing in this section is intended to eliminate consumer rights that apply based on a customer’s location.
